Did US Airways change the terms of the Share Promotion?

Earlier this month US Airways released their 100% share miles promotion, enabling you to “purchase miles” at just under 1.15 cents each. It seems like they’ve changed their terms of the promotion during the promotion period. Their original terms and conditions were as follows:

Original Terms of Share Promotion:

Miles are shared for $0.01 per mile plus a processing fee of $30 and a tax recovery charge of 7.5%. GST/HST will be charged to Canadian residents. Miles purchased through Buy, Share or Gift Miles do not count towards Dividend Miles Preferred status. All other Dividend Miles Terms and Conditions apply. Miles may be used based on award availability at the time of booking. Please note that Dividend Miles accounts less than 12 days old are not permitted to Buy, Share or Gift miles. All purchases are non-refundable.

Revised Terms of Share Promotion (as of today):

I’ve run into this myself as I’ve had transactions held up even though the trade was processed and my credit card was charged. The bolded part was clearly put in sometime during the promotion. This is extremely customer unfriendly and shady as we’ve had very little communication from points.com or US Airways on this. With all of these changes in the Terms and Conditions it’s not the miles or promotion that’s the issue but rather that the intent behind pulling a fast one on us and I find this extremely disappointing.

My friend even has a tweet of US Airways saying that new accounts can receive miles.

US Airways, if you’re reading this, I’d like a reply on why this change was done and would like you to honour the original terms of the promotion.

Readers, if you think keeping the T&C during a promotion is important please let US Airways know by tweeting them or retweeting my tweet. I do have personal involvement in this promo but I just think it’s important to not change the Terms and Conditions and expecting everyone will know.

  1. We may have ran right into that issue today. The transfer hasn’t gone through and I believe today is the account we are transferring into is 12 days old today. It also doesn’t help that today is Thanksgiving in Canada, so no way to contact points.com if it is something else. My card has been charged…

  2. I suppose US reserved the right to alter the T&Cs at any time, however, I’m pretty sure they must communicate this (in some way). Also, if the miles were shared BEFORE the T&Cs alteration (I guess is not that easy for us to determine the exact time the T&Cs have been amended), they should be (legally) bound to honor that transaction.

  3. Ugh, looks like I was caught by this last night… Now what? Credit card has been charged, miles not transferred.
